はじめに

本利用規約（以下「本規約」）は、KARABINA LLC（以下「当社」）が提供する iOS / watchOS 向けアプリ「Hotaru」（以下「本アプリ」）のご利用にあたり、ユーザーと当社との間の権利義務関係を定めるものです。本アプリをご利用いただく前に、本規約を必ずお読みください。本アプリをインストールまたは使用することで、本規約に同意したものとみなします。

第1条　サービスの利用

本アプリは、ライブ・イベント会場等でスマートフォンおよび Apple Watch を擬似ペンライトとして個人利用することを目的としたユーティリティです。本アプリは実際のペンライト・サイリウムの代替を保証するものではなく、ユーザーは会場のルールおよび実演者の意向に従って利用するものとします。

第2条　禁止事項

ユーザーは、本アプリの利用にあたり、以下の行為をしてはなりません。・法令または公序良俗に違反する行為・当社または第三者の知的財産権、プライバシー、名誉その他の権利を侵害する行為・本アプリを商業目的で無断使用する行為・本アプリのリバースエンジニアリング、逆コンパイル、または改ざんを行う行為・不正なアクセスや当社のシステムへの干渉を試みる行為・会場の利用規則・実演者の意向・会場運営者の指示に反する形で本アプリを使用する行為・本アプリを用いて他者に怪我・不快感・演出妨害を与える行為・スマートフォンを振り回す、投擲する、その他周囲の安全を危険にさらす形で本アプリを使用する行為・その他、当社が不適切と判断する行為

第3条　知的財産権

本アプリおよびそのコンテンツ（デザイン、テキスト、画像、ロゴ、カラーパレット、UI、ソースコード等）に関する知的財産権は、当社または正当な権利者に帰属します。本規約に基づくライセンスは、これらの権利をユーザーに譲渡するものではありません。

第4条　データの取り扱い

本アプリがユーザーの操作によって保存する設定情報（落下防止モーダル同意フラグ、オンボーディング完了フラグ、輝度上限設定）は、お使いのデバイス上にローカル保存されます。当社サーバーへ自動的にバックアップ・送信されることはありません。詳細は「プライバシーポリシー」をご確認ください。データの管理はユーザー自身の責任において行ってください。アプリのアンインストールにより、デバイス上に保存されたすべての設定情報が削除されます。

第5条　利用上の注意・自己責任

本アプリの利用にあたり、ユーザーは以下の事項を遵守する義務を負います。違反による事故・損害について当社は一切の責任を負いません。・スマートフォンには必ずストラップ等の落下防止装置を装着し、確実に手首または身体に装着の上で使用すること・会場のスマートフォン・電子機器使用ルールを必ず確認し、使用が禁止または制限されている場合は使用を控えること・周囲の観客・スタッフ・出演者に対して安全配慮義務を尽くし、演出・進行を妨げないよう使用すること・本アプリの輝度・発光態様はユーザーの責任において調整し、第三者へ過度のまぶしさや不快感を与えないよう配慮すること・本アプリは緊急時のフラッシュライト・救難信号としての使用を目的としておらず、安全装置・公的サービスの代替にはならないことを理解すること

第6条　免責事項

1. 本アプリは「現状有姿」で提供されるものとし、当社は本アプリの完全性、特定の目的への適合性、エラーがないこと、または特定の機種・OS バージョンでの動作について一切の保証をしません。 2. 当社は、本アプリの利用または利用不能に起因または関連して生じた一切の損害（直接損害・間接損害・付随的損害・特別損害・逸失利益・データ消失等を含むがこれらに限られない）について、当社の故意または重大な過失による場合を除き、責任を負いません。 3. 特に、以下の事象を含む（ただしこれらに限定されない）一切の結果について、当社は責任を負いません。・本アプリの使用中にスマートフォンを振る、振り回す、投擲する等の行為に起因する、スマートフォンの落下・破損・紛失・本アプリの使用中にスマートフォンが他者・出演者・ステージ・周辺機材・会場設備に接触または衝突したこと、それに起因する怪我・物損・トラブル・賠償責任・本アプリの発光・動作・操作によって周囲の観客・スタッフ・出演者に怪我・不快感・演出妨害・トラブルを生じさせたこと・本アプリの使用が原因で、イベント主催者・会場運営者・出演者またはその関係者から、警告、クレーム、強制退場、出入禁止、損害賠償請求、刑事告訴、訴訟提起その他一切の不利益処分を受けたこと・本アプリの使用が会場の利用規則、関係法令、出演者の意向、または公序良俗に反していたこと・本アプリが watchOS / iOS のシステム挙動、ハードウェア性能、自動輝度制御、OS アップデート、その他デバイス側の事情によって意図どおりに動作しなかったこと・Apple Watch のバッテリー残量・画面消灯・ペアリング状態等によって本アプリの発光が中断したこと 4. ユーザーは、本アプリの使用にあたり、自らの責任において安全配慮義務を尽くし、会場のルール、関係法令、および出演者・運営者の意向を遵守する義務を負います。

第7条　サービスの変更・停止

当社は、ユーザーへの事前通知なく、本アプリの機能の変更、追加、または提供の停止を行うことができるものとします。これによってユーザーに生じた損害について、当社は責任を負いません。

第8条　本規約の変更

当社は必要に応じて本規約を変更することがあります。変更後の規約は、本ページに掲載した時点から効力を生じるものとし、ユーザーが変更後も本アプリを継続して使用した場合、改定後の規約に同意したものとみなします。

第9条　準拠法・管轄裁判所

本規約の解釈にあたっては、日本法を準拠法とします。本アプリに関して紛争が生じた場合には、当社の本店所在地を管轄する裁判所を専属的合意管轄とします。

Introduction

These Terms of Use (the "Terms") set out the rights and obligations between you and KARABINA LLC (the "Company") regarding the use of the iOS / watchOS app "Hotaru" (the "App"). Please read these Terms carefully before using the App. By installing or using the App, you are deemed to have agreed to these Terms.

Article 1. Use of the Service

The App is a utility intended for personal use as a pen-light substitute on smartphones and Apple Watch at concerts and similar events. The App does not guarantee that it can serve as a replacement for an actual pen-light or glow stick, and you shall use it in compliance with the rules of the venue and the wishes of the performers.

Article 2. Prohibited Acts

You shall not engage in any of the following acts when using the App: - Acts that violate laws, regulations, or public order and morals - Acts that infringe intellectual property rights, privacy, reputation, or other rights of the Company or any third party - Unauthorized commercial use of the App - Reverse engineering, decompiling, or tampering with the App - Unauthorized access to or interference with the Company's systems - Use of the App in a manner contrary to the venue rules, the wishes of performers, or the instructions of venue operators - Use of the App that causes injury, discomfort, or interference with performances to others - Swinging, throwing, or otherwise using a smartphone in a manner that endangers the safety of those nearby - Any other act deemed inappropriate by the Company

Article 3. Intellectual Property

Intellectual property rights related to the App and its content (design, text, images, logos, color palette, UI, source code, etc.) belong to the Company or the rightful owners. The license under these Terms does not transfer such rights to you.

Article 4. Handling of Data

The settings stored by the App (safety disclaimer acknowledgment, onboarding completion flag, brightness limit setting) are stored locally on your device. They are not automatically backed up or transmitted to the Company's servers. For details, please refer to the Privacy Policy. You are responsible for managing your data. Uninstalling the App will delete all settings stored on your device.

Article 5. Usage Notes / Self-Responsibility

You are obligated to comply with the following when using the App. The Company assumes no responsibility for accidents or damages caused by violation of these guidelines. - Always attach a drop-prevention device such as a strap to your smartphone, and ensure it is securely worn around your wrist or body before use - Confirm the venue's rules on smartphone or electronic device use and refrain from using the App where it is prohibited or restricted - Take due care for the safety of surrounding audience members, staff, and performers, and avoid interfering with performances - Adjust the brightness and lighting behavior of the App at your own discretion to avoid causing excessive glare or discomfort to others - Understand that the App is not intended to be used as an emergency flashlight or distress signal and is not a substitute for safety devices or public services

Article 6. Disclaimer

1. The App is provided "as is," and the Company makes no warranty whatsoever as to the completeness, fitness for a particular purpose, freedom from errors, or operability on any specific device or OS version. 2. The Company shall bear no liability for any damages (including, without limitation, direct, indirect, incidental, special, or consequential damages, lost profits, or data loss) arising out of or in connection with the use of or inability to use the App, except in cases of the Company's willful misconduct or gross negligence. 3. In particular, the Company shall bear no responsibility for any of the following events (without limitation): - Drop, damage, or loss of a smartphone caused by shaking, swinging, throwing, or similar actions while using the App - Injury, property damage, trouble, or liability caused by the smartphone coming into contact with or colliding into other persons, performers, the stage, peripheral equipment, or venue facilities while the App is in use - Injury, discomfort, performance interference, or other trouble caused to surrounding audience members, staff, or performers by the lighting, operation, or use of the App - Any warning, complaint, forced removal, ban, claim for damages, criminal complaint, lawsuit, or other adverse measure brought by event organizers, venue operators, performers, or their affiliates resulting from use of the App - Use of the App in violation of venue rules, applicable laws, the wishes of performers, or public order and morals - The App not operating as intended due to system behavior of watchOS / iOS, hardware performance, automatic brightness control, OS updates, or any other device-side circumstances - Interruption of lighting due to Apple Watch battery level, screen sleep, pairing state, or similar conditions 4. You are solely responsible for safe and considerate use of the App and for complying with venue rules, applicable laws, and the wishes of performers and event organizers.

Article 7. Service Modification and Suspension

The Company may modify, add, or suspend the features of the App without prior notice to users. The Company shall not be liable for any damages incurred by users as a result.

Article 8. Changes to These Terms

The Company may modify these Terms as necessary. Modified Terms become effective when posted on this page. Your continued use of the App after such posting will be deemed acceptance of the revised Terms.

Article 9. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Japan. Any dispute arising in relation to the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Company's principal place of business as the court of first instance.
