はじめに

本利用規約（以下「本規約」）は、KARABINA LLC（以下「当社」）が提供する iOS / Android 向けアプリ「ROBBER」（以下「本アプリ」）のご利用にあたり、ユーザーと当社との間の権利義務関係を定めるものです。本アプリをご利用いただく前に、本規約を必ずお読みください。本アプリをインストールまたは使用することで、本規約に同意したものとみなします。

第1条　サービスの利用

本アプリは、ボードゲームを愛好するプレイヤーが、手元のスマートフォンを擬似サイコロとして個人利用することを目的とした補助的なユーティリティです。本アプリは、サイコロを振る、出目の統計を表示する、3D 物理シミュレーションを楽しむ等の機能を提供します。本アプリは物理的なサイコロや物理ボードゲーム製品の代替を保証するものではなく、ユーザーはご自身の判断と責任において本アプリを利用するものとします。

第2条　商標および第三者の権利

『カタン』『CATAN』、ならびに『カタンの開拓者たち（Settlers of Catan）』『カタン：航海者たち（Seafarers）』『カタン：都市と騎士（Cities & Knights）』『カタン：商人と蛮族（Traders & Barbarians）』『カタン：探検家と海賊（Explorers & Pirates）』『カタン：新エネルギー（New Energies）』『カタン：アメリカの開拓者たち（Settlers of America）』『カタン：宇宙開拓者たち（Starfarers）』その他『カタン』関連製品の名称・ロゴ・キャラクター・ボードデザインは、Catan Studio LLC、Catan GmbH、またはその関連権利者の登録商標または商標であり、各社の知的財産権はそれぞれの権利者に帰属します。本アプリは、上記の商標権者および著作権者とは独立した第三者である当社（KARABINA LLC）が制作・提供する非公式のファンメイド・ユーティリティであり、Catan Studio LLC、Catan GmbH、およびその関連会社・代理店・正規販売元との間に、提携、後援、承認、推奨、公認、ライセンス、その他いかなる業務上の関係もありません。本アプリ内のモード名（「都市と騎士」「アメリカ」「宇宙」等）における上記商標の参照は、本アプリが擬似サイコロとして併用される可能性のある物理ゲームをユーザーが識別できるようにすることのみを目的とした、記述的・指示的使用（nominative use／指示的フェアユース）であり、商標権者の権利を侵害する意図は一切ありません。本アプリは、上記権利者が著作権を有するゲームボード、ヘックスタイル、駒、開発カード、資源カード、ルールブック、公式アートワーク、ロゴその他の独自表現を、いかなる形式においても複製、改変、翻案、配布しません。本アプリ内の全てのイラスト・テキスト・UI デザイン・ダイス表現・効果音は、当社オリジナルの著作物、当社が適切にライセンスを取得したコンテンツ、または生成 AI を用いて当社が独自に作成した著作物です。本アプリは物理ゲームの代替を目的としません。実際のゲームプレイには、Catan Studio LLC、Catan GmbH、または各地域の正規販売元から公式製品をご購入ください。

第3条　知的財産権

本アプリおよびそのコンテンツ（デザイン、テキスト、画像、ロゴ、カラーパレット、UI、ソースコード、3D モデル、シェーダ、効果音等）に関する知的財産権は、当社または正当な権利者に帰属します。本規約に基づくライセンスは、これらの権利をユーザーに譲渡するものではありません。ユーザーは、当社の事前の書面による承諾なく、本アプリのコンテンツを複製、改変、翻案、二次配布、商業利用、公衆送信することはできません。

第4条　禁止事項

ユーザーは、本アプリの利用にあたり、以下の行為をしてはなりません。・法令または公序良俗に違反する行為・当社または第三者の知的財産権、プライバシー、名誉その他の権利を侵害する行為・本アプリを商業目的で無断使用する行為・本アプリのリバースエンジニアリング、逆コンパイル、または改ざんを行う行為・不正なアクセスや当社のシステムへの干渉を試みる行為・本アプリを賭博・賭け事その他の金銭的判断を伴う用途に使用する行為・本アプリの出目を、公式競技会・公式トーナメントの公式記録として、主催者の許可なく利用する行為・本アプリの名称、表現、UI が『カタン』その他のボードゲーム製品の公式アプリであるかのように第三者に誤認させる行為・その他、当社が不適切と判断する行為

第5条　データの取り扱い

本アプリがユーザーの操作によって保存する情報（モード設定、サイコロを振った履歴、出目の統計データ、外観テーマ設定、言語設定、触覚フィードバック設定、起動時リセット設定等）は、お使いのデバイス上のローカルストレージ（LocalStorage）にのみ保存されます。当社サーバーへ自動的にバックアップ・送信されることはありません。詳細は「プライバシーポリシー」をご確認ください。データの管理はユーザー自身の責任において行ってください。アプリのアンインストールにより、デバイス上に保存されたすべてのデータが削除されます。なお、本アプリの設定画面から、振った履歴・統計データをユーザーの操作により任意に削除することができます。

第6条　課金・サブスクリプション

1. 本アプリは、将来的に、追加機能・広告非表示等の有料機能（以下「Premium 機能」）を提供する場合があります。価格・機能内容は、本アプリ内および各ストア（Apple App Store / Google Play ストア）上で表示します。 2. Premium 機能は、ユーザーがダウンロードしたアプリのプラットフォームに応じて、Apple App Store の In-App Purchase または Google Play ストアの Google Play Billing を経由して提供されます。販売主体・課金処理・購入・解約・返金は、当該ストアの運営企業（Apple Inc. または Google LLC）の規約および運営ポリシーに従います。 3. Premium 機能がサブスクリプション形式である場合、ユーザーが期間満了の 24 時間前までに解約しない限り、自動的に同期間で更新されます。解約は以下の方法で行えます。・iOS：「設定＞ Apple ID ＞サブスクリプション」・Android：「Google Play ストア＞メニュー＞お支払いと定期購入＞定期購入」 4. 当社は事前通知のうえ、価格・機能の変更を行うことができます。重要な価格変更については、各ストアのポリシーに基づきユーザーへ通知します。 5. すでに支払い済みの Premium 機能料金については、原則として返金対象外となります。返金については、当該ストアの運営企業（Apple Inc. または Google LLC）の判断および規約に従います。 6. Premium 機能の一部または全機能の提供を将来予告なく終了する場合があります。その場合、当社は支払済み残期間相当の対応を行うことがありますが、義務として保証されるものではありません。

第7条　利用上の注意・自己責任

本アプリの利用にあたり、ユーザーは以下の事項を遵守するものとします。違反による損害について当社は一切の責任を負いません。・本アプリの出目は擬似乱数（pseudo-random）に基づいて生成されるものであり、物理的なサイコロと完全に同等の確率分布・公平性を保証するものではありません・本アプリを賭博・賭け事・金銭的価値を伴う判断の根拠として使用しないこと・公式の競技会・トーナメントにおいて本アプリの出目を公式記録として用いる場合は、主催者の事前許可を得ること・本アプリの統計データ（総振り回数・出目の分布・直近の出目等）は、ユーザーの参照用情報であり、その正確性・継続性は保証されないことを理解すること・本アプリは Catan Studio LLC、Catan GmbH およびその関連会社の公式アプリではないことを理解し、第三者に対して公式アプリであるかのように誤認させる態様で使用しないこと

第8条　免責事項

1. 本アプリは「現状有姿」で提供されるものとし、当社は本アプリの完全性、正確性、特定の目的への適合性、エラーがないこと、または特定の機種・OS バージョンでの動作について一切の保証をしません。 2. 当社は、本アプリの利用または利用不能に起因または関連して生じた一切の損害（直接損害・間接損害・付随的損害・特別損害・逸失利益・データ消失等を含むがこれらに限られない）について、当社の故意または重大な過失による場合を除き、責任を負いません。 3. 特に、以下の事象を含む（ただしこれらに限定されない）一切の結果について、当社は責任を負いません。・本アプリの出目が、ユーザーまたは第三者の期待する確率分布・統計的性質と異なって表示されたこと・本アプリの出目に基づくユーザーの判断・行動の結果生じた損害・トラブル・本アプリがデバイス、OS、ハードウェアの仕様、OS アップデート、自動省電力制御、サードパーティ製ライブラリの挙動、その他デバイス側の事情によって意図どおりに動作しなかったこと・LocalStorage に保存されたデータが、OS の挙動、ブラウザの設定、ユーザー操作、アプリのアンインストール等によって消失または破損したこと・本アプリが組み込む第三者の SDK・サービス（広告ネットワーク等）の挙動・障害・規約変更に起因するトラブル・本アプリの『カタン』その他ボードゲーム製品の名称参照に対して、ユーザーまたは第三者が公式アプリであると誤認したことに起因する一切のトラブル 4. ユーザーは、本アプリの使用にあたり、自らの責任において利用判断を行う義務を負います。

第9条　サービスの変更・停止

当社は、ユーザーへの事前通知なく、本アプリの機能の変更、追加、または提供の停止を行うことができるものとします。これによってユーザーに生じた損害について、当社は責任を負いません。

第10条　本規約の変更

当社は必要に応じて本規約を変更することがあります。変更後の規約は、本ページに掲載した時点から効力を生じるものとし、ユーザーが変更後も本アプリを継続して使用した場合、改定後の規約に同意したものとみなします。

第11条　準拠法・管轄裁判所

本規約の解釈にあたっては、日本法を準拠法とします。本アプリに関して紛争が生じた場合には、当社の本店所在地を管轄する裁判所を第一審の専属的合意管轄とします。

Introduction

These Terms of Use (the "Terms") set out the rights and obligations between you and KARABINA LLC (the "Company") regarding the use of the iOS / Android app "ROBBER" (the "App"). Please read these Terms carefully before using the App. By installing or using the App, you are deemed to have agreed to these Terms.

Article 1. Use of the Service

The App is a supplemental utility intended for personal use by board-game enthusiasts as a virtual dice substitute on their smartphone. The App provides functions such as rolling dice, displaying roll statistics, and offering a 3D physics simulation for entertainment. The App does not guarantee equivalence to physical dice or any physical board-game product, and you shall use it at your own discretion and responsibility.

Article 2. Trademarks and Third-Party Rights

CATAN, and the names, logos, characters, and board designs of "Settlers of Catan," "Catan: Seafarers," "Catan: Cities & Knights," "Catan: Traders & Barbarians," "Catan: Explorers & Pirates," "Catan: New Energies," "Catan: Settlers of America," "Catan: Starfarers," and any other CATAN-related products are registered trademarks or trademarks of Catan Studio LLC, Catan GmbH, or their respective rights holders, and the intellectual property rights of each company belong to their respective owners. The App is an unofficial, fan-made utility independently created and provided by the Company (KARABINA LLC), an entity unrelated to the above trademark and copyright holders. The App has no business affiliation, sponsorship, endorsement, approval, certification, license, or any other commercial relationship with Catan Studio LLC, Catan GmbH, or any of their affiliates, distributors, or authorized resellers. References to the above trademarks within mode names in the App (such as "Cities & Knights," "Settlers of America," "Starfarers") constitute nominative fair use, intended solely to allow users to identify the physical games with which the App may be used as a virtual dice companion. No infringement of trademark rights is intended. The App does not reproduce, modify, adapt, or distribute, in any form, the game boards, hex tiles, pieces, development cards, resource cards, rule books, official artwork, logos, or any other expressive content for which the above rights holders hold copyrights. All illustrations, text, UI design, dice representations, and sound effects within the App are original works of the Company, content properly licensed by the Company, or works independently produced by the Company using generative AI. The App is not intended as a replacement for the physical game. For actual gameplay, please purchase official products from Catan Studio LLC, Catan GmbH, or authorized regional distributors.

Article 3. Intellectual Property

Intellectual property rights related to the App and its content (design, text, images, logos, color palette, UI, source code, 3D models, shaders, sound effects, etc.) belong to the Company or the rightful owners. The license under these Terms does not transfer such rights to you. You may not reproduce, modify, adapt, redistribute, commercially use, or publicly transmit any content of the App without the prior written consent of the Company.

Article 4. Prohibited Acts

You shall not engage in any of the following acts when using the App: - Acts that violate laws, regulations, or public order and morals - Acts that infringe intellectual property rights, privacy, reputation, or other rights of the Company or any third party - Unauthorized commercial use of the App - Reverse engineering, decompiling, or tampering with the App - Unauthorized access to or interference with the Company's systems - Use of the App for gambling, wagering, or other purposes involving monetary judgments - Use of dice results from the App as official records in tournaments or official competitions without the organizer's permission - Use of the App's name, expression, or UI in a manner that misleads third parties into believing it is an official app of CATAN or any other board-game product - Any other act deemed inappropriate by the Company

Article 5. Handling of Data

The information stored by the App (mode selection, dice roll history, roll statistics, appearance theme, language setting, haptic feedback setting, reset-on-launch setting, etc.) is stored only in the local storage (LocalStorage) of your device. It is not automatically backed up or transmitted to the Company's servers. For details, please refer to the Privacy Policy. You are responsible for managing your data. Uninstalling the App will delete all data stored on your device. You may also delete your roll history and statistics at any time from the Settings screen within the App.

Article 6. Subscriptions and In-App Purchases

1. The App may, in the future, offer paid features such as ad removal or additional functionality (collectively, "Premium Features"). Pricing and feature details will be displayed within the App and on each store (Apple App Store / Google Play Store). 2. Premium Features are provided through Apple App Store In-App Purchase or Google Play Billing depending on the platform from which the App was downloaded. The sales entity, payment processing, purchase, cancellation, and refund are governed by the terms and policies of the respective store operator (Apple Inc. or Google LLC). 3. If a Premium Feature is offered on a subscription basis, it will automatically renew for the same period unless canceled at least 24 hours before the end of the current period. Cancellation can be performed as follows: - iOS: Settings ▸ Apple ID ▸ Subscriptions - Android: Google Play Store ▸ Menu ▸ Payments & subscriptions ▸ Subscriptions 4. The Company may change prices and feature contents with prior notice. Material price changes will be communicated to users in accordance with each store's policies. 5. Premium Feature fees already paid are, as a general rule, not refundable. Refunds are subject to the judgment and terms of the respective store operator (Apple Inc. or Google LLC). 6. The Company may discontinue some or all Premium Features in the future without prior notice. In such cases, the Company may take measures equivalent to the unused portion of the paid period, but this is not guaranteed as an obligation.

Article 7. Usage Notes / Self-Responsibility

You are obligated to comply with the following when using the App. The Company assumes no responsibility for damages caused by violation of these guidelines. - The dice results in the App are generated based on pseudo-random numbers and do not guarantee exactly the same probability distribution or fairness as physical dice - You shall not use the App for gambling, wagering, or any judgment involving monetary value - When using dice results from the App as official records in tournaments or official competitions, obtain prior permission from the organizer - Understand that the statistical data displayed in the App (total roll count, distribution of results, recent rolls, etc.) is informational for the user's reference, and its accuracy and continuity are not guaranteed - Understand that the App is not an official app of Catan Studio LLC, Catan GmbH, or their affiliates, and shall not be used in a manner that misleads third parties into believing it is an official app

Article 8. Disclaimer

1. The App is provided "as is," and the Company makes no warranty whatsoever as to the completeness, accuracy, fitness for a particular purpose, freedom from errors, or operability on any specific device or OS version. 2. The Company shall bear no liability for any damages (including, without limitation, direct, indirect, incidental, special, or consequential damages, lost profits, or data loss) arising out of or in connection with the use of or inability to use the App, except in cases of the Company's willful misconduct or gross negligence. 3. In particular, the Company shall bear no responsibility for any of the following events (without limitation): - Dice results in the App differing from the probability distribution or statistical properties expected by users or third parties - Damages or troubles arising from user decisions or actions based on dice results from the App - The App not operating as intended due to device specifications, OS, hardware, OS updates, automatic power-saving controls, behavior of third-party libraries, or other device-side circumstances - Data stored in LocalStorage being lost or corrupted due to OS behavior, browser settings, user operations, app uninstallation, etc. - Troubles caused by the behavior, failures, or changes in terms of third-party SDKs or services (ad networks, etc.) embedded in the App - Any troubles arising from users or third parties mistakenly believing the App to be an official app due to its references to CATAN or other board-game product names 4. You are solely responsible for exercising your own judgment in using the App.

Article 9. Service Modification and Suspension

The Company may modify, add, or suspend the features of the App without prior notice to users. The Company shall not be liable for any damages incurred by users as a result.

Article 10. Changes to These Terms

The Company may modify these Terms as necessary. Modified Terms become effective when posted on this page. Your continued use of the App after such posting will be deemed acceptance of the revised Terms.

Article 11. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Japan. Any dispute arising in relation to the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Company's principal place of business as the court of first instance.
