利用規約

はじめに

本利用規約（以下「本規約」）は、KARABINA LLC（以下「当社」）が提供するライブ・イベント管理アプリ「Grape」（以下「本アプリ」）のご利用にあたり、ユーザーと当社との間の権利義務関係を定めるものです。本アプリをご利用いただく前に、本規約を必ずお読みください。本アプリをインストールまたは使用することで、本規約に同意したものとみなします。

第1条　サービスの利用

本アプリは、ライブ・イベントのスケジュール管理、チケット情報の記録、および参加統計の確認を目的とした個人利用向けアプリです。ユーザーは、本規約の定めに従い、当社が許諾する範囲内で本アプリを利用することができます。

本アプリおよびそのコンテンツ（デザイン、テキスト、画像、ロゴ等）に関する知的財産権は、当社または正当な権利者に帰属します。本規約に基づくライセンスは、これらの権利をユーザーに譲渡するものではありません。

第4条　データの取り扱い

ユーザーが本アプリに入力したデータ（イベント情報、アーティスト情報、セットリスト、画像等）は、原則としてお使いのデバイス上にローカル保存されます。当社サーバーへ自動的にバックアップされることはありません。ただし、URL 取り込み機能・楽曲検索機能を利用した場合は、入力された URL や検索キーワード等の一部情報が、当社 API 経由で第三者サービスに処理目的で一時的に送信されます。詳細は「プライバシーポリシー」をご確認ください。データの管理・バックアップはユーザー自身の責任において行ってください。アプリのアンインストールにより、デバイス上に保存されたすべてのデータが削除されます。

第5条　免責事項

当社は、本アプリの利用によってユーザーに生じた損害（データの消失、機会損失等）について、当社の故意または重大な過失による場合を除き、一切の責任を負いません。また、本アプリは「現状有姿」で提供されるものとし、特定の目的への適合性、正確性、継続性について保証しません。

第6条　サービスの変更・停止

当社は、ユーザーへの事前通知なく、本アプリの機能の変更、追加、または提供の停止を行うことができるものとします。これによってユーザーに生じた損害について、当社は責任を負いません。

第7条　本規約の変更

当社は必要に応じて本規約を変更することがあります。変更後の規約は、本ページに掲載した時点から効力を生じるものとし、ユーザーが変更後も本アプリを継続して使用した場合、改定後の規約に同意したものとみなします。

第8条　準拠法・管轄裁判所

本規約の解釈にあたっては、日本法を準拠法とします。本アプリに関して紛争が生じた場合には、当社の本店所在地を管轄する裁判所を専属的合意管轄とします。

第9条　サブスクリプション

1. 本アプリは月額および年額のサブスクリプション（以下「Premium プラン」）を提供することがあります。価格・機能内容は本アプリ内および App Store 上で表示します。 2. Premium プランは Apple App Store の In-App Purchase を経由して提供され、購入・解約・返金は Apple の規約および App Store の運営ポリシーに従います。 3. サブスクリプションは期間満了の 24 時間前までに解約しない限り、自動的に同期間で更新されます。解約は iOS の「設定 > Apple ID > サブスクリプション」から行えます。 4. 当社は事前通知のうえ、価格・機能の変更を行うことができます。重要な価格変更については Apple のポリシーに基づきユーザーへ通知します。 5. すでに支払い済みのサブスクリプション料金については、原則として返金対象外となります。返金については Apple の判断および規約に従います。 6. Premium プランの一部または全機能の提供を将来予告なく終了する場合があります。その場合、当社は支払済み残期間相当の対応を行うことがありますが、義務として保証されるものではありません。 7. 本アプリの Premium プランは Apple Inc. が運営する App Store の In-App Purchase を通じて提供されます。販売主体および決済処理は Apple Inc. が行い、当社は Apple から手数料を控除した支払いを受領します。購入・更新・返金・解約に関する Apple の規約およびポリシーが優先的に適用されます。

Introduction

These Terms of Service ("Terms") govern your use of Grape, a live event management app ("App") provided by KARABINA LLC ("we," "us," or "our"). Please read these Terms carefully before using the App. By installing or using the App, you agree to be bound by these Terms.

Article 1 — Use of the App

The App is a personal-use tool for managing live event schedules, recording ticket information, and viewing attendance statistics. You may use the App within the scope permitted by these Terms.

Article 2 — Prohibited Activities

You agree not to engage in any of the following when using the App: · Violating any applicable laws or regulations · Infringing on the intellectual property, privacy, or other rights of us or third parties · Using the App for unauthorized commercial purposes · Reverse engineering, decompiling, or tampering with the App · Attempting unauthorized access to or interference with our systems · Any other conduct we deem inappropriate

Article 3 — Intellectual Property

All intellectual property rights in the App and its content (including design, text, images, and logos) belong to us or our licensors. These Terms do not transfer any such rights to you.

Article 4 — Your Data

Data you enter into the App (events, artists, setlists, images, etc.) is, in principle, stored locally on your device. It is not automatically backed up to our servers. However, when you use the URL import feature or song search feature, some information you enter (such as URLs or search keywords) is temporarily transmitted through our API to third-party services for processing purposes. Please refer to our Privacy Policy for details. You are solely responsible for managing and backing up your data. Uninstalling the App will permanently delete all data stored on your device.

Article 5 — Disclaimer

To the extent permitted by law, we disclaim all liability for any damages arising from your use of the App (including data loss or missed opportunities), except in cases of our intentional misconduct or gross negligence. The App is provided "as is" without warranties of any kind, including fitness for a particular purpose, accuracy, or continuity.

Article 6 — Changes and Suspension

We may modify, add to, or discontinue features of the App at any time without prior notice. We are not liable for any loss resulting from such changes.

Article 7 — Changes to These Terms

We may update these Terms at any time. Revised Terms take effect when posted on this page. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

Article 8 — Governing Law

These Terms are governed by the laws of Japan. Any disputes arising in connection with the App shall be subject to the exclusive jurisdiction of the court with jurisdiction over our principal place of business.

Article 9 — Subscription

1. The App may offer monthly and annual subscriptions (the "Premium Plan"). Prices and feature details are displayed within the App and on the App Store. 2. Premium Plans are provided through Apple App Store In-App Purchase. Purchase, cancellation, and refunds are subject to Apple's terms and App Store policies. 3. Subscriptions automatically renew for the same duration unless canceled at least 24 hours before the end of the current period. You can cancel via iOS Settings > Apple ID > Subscriptions. 4. We may change prices or features with prior notice. Significant price changes will be communicated to users in accordance with Apple's policies. 5. Subscription fees already paid are generally non-refundable. Refunds are subject to Apple's discretion and policies. 6. We may discontinue some or all Premium features in the future without prior notice. In such cases, we may offer compensation for the remaining paid period, but this is not guaranteed as an obligation. 7. Premium Plans for the App are provided through In-App Purchase on the App Store operated by Apple Inc. Apple Inc. is the merchant of record and processes payment; we receive payment from Apple net of their commission. Apple's terms and policies regarding purchase, renewal, refund, and cancellation take precedence.
